Series of interactive meetings with specialists of the European Union Advisory Mission (EUAM) Ukraine have been held at Lviv State University of InternalAffairs. This time the cadets had an opportunity to talk to Dmytro Bohdan, an Expert on the Reform of the Prosecutor's Office of Lviv Regional Office of the EUAM, and Marcus Rolofs, Adviser and Trainer on Rule of Law.
Ensuring the rights of detainees was discussed during the online meeting.
It should be noted that the event was joined not only by applicants from Lviv State University of Internal Affairs, but also from Dnipro and Donetsk Universities of Internal Affairs.
Dmytro Bohdan stressed that the detention of a person on the basis of a court means the detention of a suspect to resolve the issue of choosing a measure of restraint."Sometimes a person is detained without a court decision. This need arises suddenly and is urgent. I would like to note that this is the main type of temporary precautionary measure to stop a criminal offense or prevent a person from avoiding an investigation," explained the expert on reforming the Prosecutor's Office of Ukraine.
The EUAM representative added that the period of detention of a person without a court decision may not exceed 72 hours.
Dmytro Bohdan also informed the audience that an authorized official has the right to detain a person without the decision of the investigating judge and the court.
In the second part of the seminar, Marcus Rolofs told the cadets about international legal standards for the detention of a person in criminal proceedings. The main emphasis of the advisor-coach was on the European experience in this area.
The Mission spokesman emphasized that the police first of all and foremost must protect human rights. Marcus Rolofs stressed that the basis of the law that a law enforcement officer should be guided by is the Convention for the Protection of Human Rights and Fundamental Freedoms and the Universal Declaration of Human Rights. During the event, the EUAM specialists repeatedly asked the cadets interesting questions, which the applicants successfully answered.
