I. GENERAL PROVISIONS
1. This Statute has been developed by the legislation of Ukraine, and it is a constituent document regulating the activities of Lviv State University of Internal Affairs (hereinafter referred to as the University).
2. The full name of the University is
in Ukrainian: Lvivskyi derzhavnyi universytet vnutrishnikh sprav (abbreviated as LvDUVS);
in English: Lviv State University of Internal Affairs.
3. The University is a non-profit state higher education institution with specific learning conditions, which belongs to the MIA management and is a budgetary institution.
4. The University is the legal successor of Lviv Law Institute of Kyiv National University of Internal Affairs (EDRPOU code 08571446) following the Resolution of the Cabinet of Ministers of Ukraine No. 1266 ‘Issues of Higher Education Institutions of the Ministry of Internal Affairs’ of December 23, 2005.
5. The location of the University (legal address): 26 Horodotska Street, Lviv, Lviv region, Ukraine, 79007.
6. The main tasks of the University:
-
carrying out educational activities in accredited educational programmes (specialities) that provide training of specialists of the relevant educational degrees in full-time, part-time and distance learning and meet the standards of higher education;
-
carrying out scientific, scientific-technical, creative, cultural, educational, sports and recreational activities;
-
ensuring the fulfilment of state orders and contracts for the training of specialists with higher education;
-
training of scientific and scientific-pedagogical personnel;
-
certifying persons obtaining bachelor's, master's, doctoral degrees, awarding doctoral degrees, conferring academic titles of associate professor, professor and senior researcher;
-
organising and conducting educational and scientific, scientific, scientific and methodological conferences, symposia, seminars, round tables, trainings, competitions, including national and international ones;
-
organising postgraduate education;
-
preparing for admission of citizens of Ukraine, foreigners and stateless persons permanently residing in Ukraine, and persons granted refugee status in Ukraine, and other persons under the legislation of Ukraine;
-
ensuring the cultural and spiritual development of the individual, fostering respect for the ideals of civil society, the rule of law, the highest social values and the law-governed state in persons receiving education at the University, to improve the educational and cultural level and patriotic education of citizens;
-
forming a personality through patriotic and legal education, promoting moral values, social activity, civic position and responsibility, and a healthy lifestyle among participants in the educational process;
-
providing paid services under the legislation of Ukraine;
-
conducting educational activities that ensure that persons receive vocational (vocational and technical) education and higher education of the appropriate degree in the chosen specialities and educational programmes;
-
international cooperation and foreign economic activity in the field of vocational (vocational and technical), higher education, science, culture, etc.;
-
other tasks under the legislation of Ukraine.
7. The main activities of the University are:
-
training of specialists to ensure the protection of human rights and freedoms, interests of society and the state, combating crime, maintaining public security and order under the relevant educational programmes at the initial (short cycle), first (bachelor's), second (master's), third (educational and scientific) levels of higher education, the successful completion of which is the basis for awarding the relevant degrees of higher education: bachelor; master; doctor of philosophy;
-
training of specialists in scientific specialities and awarding them the degree of Doctor of Science;
-
initial professional training of police officers who are first recruited to the police and postgraduate education of employees of the National Police of Ukraine, other central executive authorities, institutions and organisations;
-
organisation and conduct of basic general military training for Ukrainian citizens who receive higher education and police officers;
-
professional orientation of pupils of schools, lyceums, gymnasiums, other general secondary education institutions and students of higher education institutions aimed at assisting individuals in active, conscious professional self-determination;
-
conducting fundamental and applied research at the expense of the state budget or other sources of funding not prohibited by law, as well as initiative research aimed at scientific and methodological support of the bodies (units) of the National Police of Ukraine and other state bodies, ensuring the implementation of their results in practice;
-
methodological and publishing activities, publication of textbooks, manuals, and methodological materials.

ensuring the organisation of the educational process, taking into account the vocations, interests and abilities of students;
-
conducting scientific and pedagogical activities on an innovative basis, organising the educational process taking into account the latest achievements in the field of higher education pedagogy;
-
establishing and expanding external relations with educational institutions, enterprises, establishments, organisations, state, law enforcement and human rights bodies of Ukraine and foreign countries, international organisations;
-
other activities under the legislation of Ukraine.
8. The activities of the University are carried out by the Constitution of Ukraine, laws of Ukraine, resolutions of the Verkhovna Rada of Ukraine, acts of the President of Ukraine, acts of the Cabinet of Ministers of Ukraine, regulations of the MIA, the central executive body that ensures the formation and implementation of state policy in the fields of education and science, as well as this Statute.
9. The activity of political parties, movements and public organisations with political purposes is not allowed at the University. Trade unions and other non-political associations of citizens may be created at the University to ensure the collective and individual interests of the members of the labour collective.
10. Interference of public authorities in the educational, scientific, financial and economic and other activities of the University is allowed only in cases stipulated by the legislation of Ukraine, as well as determined by the specific learning conditions.
11. The educational process and office work at the University shall be carried out in the state language. The use of other languages is possible in cases stipulated by Ukraine's legislation on languages and agreements on international cooperation.
12. Structural subdivisions of the University are: educational and scientific institutes, faculties, departments, libraries, laboratories, centres, departments, and units, etc.
Structural subdivisions of the University are formed by the decision of the Academic Council (hereinafter referred to as the Academic Council) of the University in agreement with the Ministry of Internal Affairs under legislation of Ukraine and the main tasks of the University.
The University has the right to establish territorially separate structural subdivisions following the procedure established by the legislation of Ukraine.
13. The University has a structural subdivision: Centre for Initial Professional Training ‘Police Academy’.
14. Separate structural subdivisions of the University shall not have the status of a legal entity, shall be endowed with the property of the University and shall operate based on regulations approved by the order of the University and under the obtained licences for educational and economic activities.
15. The autonomy of the University is independence and responsibility in decision-making regarding the development of academic freedoms, organisation of the educational process, research, internal management, economic and other activities established by the Laws of Ukraine ‘On Education’, ‘On Vocational (Vocational and Technical) Education’, ‘On Higher Education’, ‘On the National Police’, other regulatory legal acts of the Cabinet of Ministers of Ukraine, the Ministry of Education and Science of Ukraine, the Ministry of Internal Affairs of Ukraine, taking into account the peculiarities determined by the specific learning conditions.
II. CONCEPT OF EDUCATIONAL ACTIVITY
1. The educational activity of the University is based on the conceptual foundations of the National Doctrine of Education Development, approved by the Decree of the President of Ukraine of April 17, 2002 No. 347/2002, the Laws of Ukraine ‘On Education’, ‘On Professional Pre-Higher Education’, ‘On Vocational (Vocational and Technical) Education’, ‘On Higher Education’, ‘On Scientific and Scientific and Technical Activities’, and the Strategy for the Development of Higher Education in Ukraine for 2022-2032, approved by the Cabinet of Ministers of Ukraine on February 23, 2022, No. 286-p.
2. The main purpose of the Concept of educational activity of the University:
-
determination of educational activity as a priority direction of the University's functioning;
-
forming a stable academic reputation of the University by ensuring competitiveness through guaranteed quality of education;
-
providing law enforcement activities with qualified specialists;
-
improvement of educational and methodological work, stimulation of scientific and pedagogical staff to prepare textbooks, manuals, other educational and methodological literature, training programmes that are modern in content and form;
-
expanding the University's activities in the field of postgraduate education;
-
formation of high-quality scientific and pedagogical, pedagogical and scientific potential of the University staff;
-
stimulation of scientific, scientific-pedagogical and pedagogical workers to self-development and professional development;
-
promoting the implementation of scientific (scientific and technical) work at the University to meet the needs of the educational process and law enforcement agencies;
-
ensuring the development of scientific and innovative activities;
-
ensuring compliance with academic integrity by participants in the educational process.
3. Educational activities are carried out under the legislation of Ukraine and are based on the principles of:
-
humanism, democracy, priority of universal values;
-
gender equality, non-discrimination, intolerance to sexism and sexist behaviour;
-
autonomy and self-government;
-
the inseparability of the processes of learning, scientific (scientific and technical) work and practical activity;
-
compliance with the requirements of education standards;
-
degree training of specialists;
-
ensuring the quality of educational services;
-
multidisciplinarity;
-
intensification of the educational process through measures of innovative development of education;
-
integration into the global educational space;
-
monitoring the quality of education, ensuring its transparency, and promoting public control;
-
academic integrity.
4. Ways to achieve the goals of educational activities:
-
updating (revision) of educational programmes and educational content;
-
introduction of educational standards for each educational level;
-
ensuring access to education for all segments of the population;
-
improving the quality of educational services;
-
professional development of pedagogical, research and teaching staff of the University;
-
introduction of the latest teaching technologies.
5. The organisation of the educational process and scientific activity is regulated by the relevant regulations approved by the Academic Council of the University.
6. Observance of academic integrity by pedagogical, scientific-pedagogical and research workers of the University provides for:
-
compliance with the requirements of academic integrity in the implementation of pedagogical, scientific-pedagogical and scientific activities, as well as control over their compliance by students and other participants in the educational process;
-
formation of zero tolerance to any manifestations of corruption, harassment, bullying;
-
providing reliable information on the results of their own educational (scientific, creative) activities, research methods and sources of information;
-
objective assessment of learning outcomes;
-
compliance with copyright and related rights legislation;
-
references to sources of information in case of using ideas, developments, statements, or data.
7. Observance of academic integrity by students at the University provides for:
-
independent completion of academic tasks, tasks of current and final control of learning outcomes, certification (for persons with special educational needs, this requirement is applied taking into account their individual needs and capabilities);
-
references to sources of information in case of using ideas, developments, statements, data;
-
compliance with copyright and related rights legislation;
-
providing reliable information on the results of their own educational (scientific, creative) activities, research methods and sources of information.
8. The content of education, terms, forms and methods of training shall be determined by the relevant educational programmes, which are approved by the established procedure.
9. Carrying out initial professional training of police officers who are newly recruited to the Police.
10. Educational activities of the University shall not depend on the influence of political, public and religious organisations.
III. RIGHTS AND OBLIGATIONS OF THE FOUNDER
1. The University is a state higher education institution with specific conditions of education, which belongs to the sphere of management of the Ministry of Internal Affairs and is founded by the legislation.
2. The founder of the University is the Ministry of Internal Affairs.
3. The competence of the Ministry of Internal Affairs includes:
-
approval of the Statute of the University upon submission of the general meeting (conference) of the University staff, amendments to it, and control over its observance;
-
control over the quality assurance of higher education;
-
coordination of activities on the organisation of the budget process;
-
controlling the efficiency of use and preservation of the property assigned to the University;
-
ensuring, within the powers provided for by the legislation of Ukraine, the implementation of measures to prevent and combat corruption, control over its implementation at the University;
-
providing staff training for the Ministry of Internal Affairs, the National Police of Ukraine, other central executive authorities, institutions, enterprises and organisations of Ukraine based on the University;
-
ensuring the formation of proposals and approval of the scope of the state order for training of specialists, scientific, scientific-pedagogical, working personnel and postgraduate education for the National Police of Ukraine, other central executive authorities, institutions and organisations of Ukraine;
-
ensuring the distribution and employment of graduates who have studied under the state order;
-
approval of heads of attestation commissions and commissions for the distribution of graduates, taking into account proposals of the National Police of Ukraine;
-
appointment and dismissal of the Rector of the University;
-
approval of appointment and dismissal of vice-rectors;
-
approval of appointment of police officers seconded to the University under Article 71 of the Law of Ukraine ‘On the National Police’ and remaining in the service of the police, heads of independent structural units in the areas of educational, scientific activities, personnel, financial and material support, as well as educational and research institutes (faculties), laboratories.
-
approval of the organisational and staff structure (staff) and staffing of the University;
-
deciding to establish the Supervisory Board of the University and approving its composition;
-
exercising other powers by the legislation and the Statute of the University.
4. The Ministry of Internal Affairs, by its regulations, has the right to establish special requirements for:
-
management of the University and organisation of the educational process in it;
-
activities and powers of the governing bodies and public self-government of the University;
-
candidates for the positions of heads (deputy heads) of the University, its main structural units;
-
appointment and dismissal of heads (deputy heads) of the University, their main structural units;
-
regulations on the development and approval of the University's educational programs, in addition to the competencies and program learning outcomes defined by higher education standards;
-
candidates for positions of teaching, academic, and research staff, as well as the competitive selection process for teaching, academic, and research positions at the University;
-
implementation of the rights and duties of teaching, academic, and research staff, and persons obtaining education at the University;
-
dismissal, suspension of studies, reinstatement, and transfer of cadets, trainees, adjuncts (postgraduates), and doctoral students enrolled at the University;
-
training of academic and research personnel at the University;
-
norms of the number of cadets, trainees, students, adjuncts (postgraduates) per one academic staff position at the University;
-
regulations on the training of higher education applicants for the Doctor of Philosophy degree at the University;
-
formation of individual study plans and individual educational trajectories for higher education applicants at the University;
-
practical training of persons obtaining higher education at the University;
-
regulations on selection, assignment, and admission for studies under the state order at the University.
5. The Ministry of Internal Affairs approves the estimate, plans of allocations of the general budget fund, plans of the special fund, plans of use of budgetary funds, monthly plans of use of budgetary funds, organisational and staff structure (staff) and staff list of the University, proposed changes to them.
6. The MIA organisationally ensures the implementation of educational, scientific, financial and economic activities of the University through the authorised structural unit of the MIA apparatus.
7. The MIA exercises control over the financial and economic activities of the University through the authorised structural unit of the MIA.
8. The MIA exercises other powers under the legislation of Ukraine.
IV. SCOPE OF THE UNIVERSITY’S CIVIL LEGAL CAPACITY
1. The civil legal capacity of the University arises from the moment of its establishment and terminates on the date when a record of its dissolution is entered into the Unified State Register of Legal Entities, Individual Entrepreneurs, and Public Associations.
2. The University is a legal entity operating on a non-profit basis. It has its symbols (logo, emblem, shoulder patch), flag, separate property, seals bearing the image of the State Emblem of Ukraine and its name, stamps with its name, letterheads, and may, on its behalf, acquire property and personal non-property rights, assume obligations, act as a plaintiff or defendant in court, maintain an independent balance sheet, hold accounts with the relevant bodies of the State Treasury Service, and accounts in banking institutions, among others.
3. The University operates on the principles of:
autonomy and self-governance;
independence from political parties, public and religious organisations.
4. The University has the right to:
-
enter into legal transactions;
-
provide higher education training for applicants intending to work in the National Police of Ukraine, other central executive authorities whose activities are directed and coordinated by the Cabinet of Ministers of Ukraine through the Minister of Internal Affairs of Ukraine, as well as other state authorities of Ukraine. This may also be carried out under contracts with individuals and legal entities in Ukraine and under agreements and contracts concluded with individuals and legal entities from foreign countries, subject to obtaining the appropriate licenses for educational activities;
-
conduct the training and certification of scientific and scientific-pedagogical personnel;
-
provide initial professional training, postgraduate education, and retraining of personnel for the National Police of Ukraine, other central executive bodies, institutions, and organisations;
-
carry out fundamental and applied scientific research, including at the request of the Ministry of Internal Affairs, the National Police of Ukraine, the National Guard of Ukraine, other central executive authorities whose activities are coordinated through the Minister of Internal Affairs, and state authorities of Ukraine, as well as on a contractual basis;
-
conduct scientific and scientific-technical evaluations in the field of scientific and technical developments and research and development projects, including at the stage of their practical implementation, following the procedure established by the legislation of Ukraine;
-
initiate proposals to the bodies that manage higher education, while simultaneously informing the founder about amendments to existing regulations or the development of new regulations in the field of higher education;
-
submit proposals to the Ministry of Internal Affairs, in the manner established by Ukrainian legislation, regarding the procedure for the selection, referral, and enrollment of students under the state order;
-
comply with the legally established teaching workload for academic, scientific-pedagogical, and scientific staff of the University.
-
determine the content of the educational process under state standards and educational programs, develop and approve curricula in the prescribed manner, and make amendments and additions to them;
-
define the types of educational activities and the number of hours allocated for their study according to the state standard, while the forms of organisation of the educational process shall be agreed upon with the Ministry of Internal Affairs;
-
carry out activities related to state secrets under the legislation of Ukraine;
-
employ and dismiss pedagogical, scientific, scientific-pedagogical, and other personnel following the requirements of Ukrainian legislation;
-
involve leading scientists and employees of state authorities, institutions, and organisations in the educational process on a contractual basis, under Ukrainian legislation;
-
submit proposals to the Ministry of Internal Affairs regarding the transfer of University property to the management of other bodies authorised to manage state property, into municipal ownership, and the transfer of objects of municipal ownership into state ownership, with their inclusion in the University's property;
-
submit proposals to the Ministry of Internal Affairs regarding changes to the organisational and staffing structure (staff list) and staffing schedule;
-
introduce its symbols and attributes;
-
provide educational, scientific, and other paid services under Ukrainian legislation;
-
engage in publishing activities, develop its printing infrastructure, including publishing and distributing educational, scientific, and methodological literature, scientific and scientific-methodical journals, information-analytical collections, other periodicals and one-time publications, and provide printing services.
-
publish print media following the established procedure, create television and radio programmes and broadcasts, Internet resources, etc. To ensure the educational process, provide telecommunication services through segments of local computer networks in the field of using its information resource, automated databases and search engines;
-
cooperate with other educational institutions, including foreign ones, as well as enterprises, institutions, and organisations, including public and human rights organisations, based on relevant cooperation agreements;
-
conduct educational activities jointly with foreign educational institutions under coordinated educational programs;
-
carry out international cooperation and foreign economic activity in the field of higher education under the legislation of Ukraine;
-
implement a rating-based evaluation system for the educational, research, and innovative achievements of participants in the educational process;
-
provide preparatory education for admission to higher education institutions, including for foreign citizens, as well as train specialists for foreign states under intergovernmental agreements and agreements or contracts concluded with higher education institutions, enterprises, organisations, and individuals from foreign countries, following the University’s admission rules and license;
-
based on the decision of the examination commission, award appropriate higher education degrees to students who, under Ukrainian legislation, have completed the certification process after finishing a certain level of higher education, and confer the corresponding qualification;
-
make decisions regarding the awarding of academic degrees and the conferring of academic titles;
-
receive funds and material assets (buildings, facilities, equipment, vehicles, etc.) in the prescribed manner from state authorities, local governments, enterprises, institutions, organisations (including charitable ones), and individuals;
-
purchase, lease, or order – using allocated funds or funds received from its core activities, provision of paid educational services, or other sources of financing defined by Ukrainian legislation – equipment, devices, and other material resources for ensuring statutory activities, and conclude other business contracts by the established procedure.
-
allocate, in the prescribed manner, funds received from core activities and additional sources of financing defined by Ukrainian legislation for capital construction, reconstruction, major and current repairs of fixed assets, and for the improvement of social and household facilities;
-
establish and maintain teams for vocational-applied and sports games, creative groups, and amateur performance collectives;
-
create databases following the needs of educational activities;
-
use land plots in the manner established by the Land Code of Ukraine;
-
participate in the work of international organisations;
-
engage in medical practice within the scope of its authority;
-
purchase, store, register, transport, and use firearms, ammunition, and special equipment following the procedure established by the legislation of Ukraine.
-
have shooting ranges, conduct training and provide training shooting services under the legislation of Ukraine;
-
ensure access to the territory of the University facilities, the functioning of the pass office, checkpoints, posts with access functions at the entrances (exits) to (from) the territories and facilities of the University, installation of technical means of access control, video surveillance;
-
comply with the rules of the internal facility regime and internal labour regulations;
-
for the period of martial law, by the decision of the Ministry of Internal Affairs, carry out defence procurement and enter into state contracts (agreements) under the legislation of Ukraine;
-
carry out other types of financial and economic activities not prohibited by the legislation of Ukraine;
-
have other rights under the laws of Ukraine.
5. The University is obliged to:
-
comply with the requirements of the Constitution of Ukraine, laws of Ukraine, resolutions of the Verkhovna Rada of Ukraine, acts of the President of Ukraine, resolutions and orders of the Cabinet of Ministers of Ukraine, regulations of the Ministry of Education and Science of Ukraine, the Ministry of Internal Affairs of Ukraine, other regulations in the field of education and science, as well as this Statute;
-
ensure, within the limits of authority, the implementation of measures to prevent and combat corruption, control over its implementation at the University and strict compliance with the provisions of the Law of Ukraine ‘On Prevention of Corruption’, the State Anti-Corruption Programme for the implementation of the principles of state anti-corruption policy in Ukraine (Anti-Corruption Strategy), The Anti-Corruption Programme of the Ministry of Internal Affairs of Ukraine and other regulations on corruption prevention;
-
ensure harmless and safe conditions of service, study, work and life, observance of the legal rights and interests of persons studying and working at the University;
-
ensure proper conditions for the provision of educational services;
-
comply with the standards of education and curricula, taking into account licensing requirements;
-
organise basic general military training for citizens of Ukraine who receive higher education and police officers;
-
ensure social protection of participants in the educational process and other employees of the University;
-
adhere to financial and budgetary discipline, preserve state property;
-
ensure the preservation of state secrets and compliance with the secrecy regime;
-
fulfil contractual obligations with other subjects of educational, industrial, scientific activities, individuals, as well as under international agreements;
-
send graduates who have studied under the state order for employment following the distribution;
-
take measures, in particular by introducing appropriate modern technologies, to prevent and detect academic plagiarism in scientific works of research, teaching, scientific, other employees and students of higher education;
-
publish on the official website, on information stands and in any other way, information on the exercise of their rights and fulfilment of obligations;
-
have an internal system to ensure the quality of educational activities and the quality of education;
-
ensure an appropriate level of representation of Ukrainian science, education and culture in the implementation of international programmes.
6. The rights and obligations of pedagogical, scientific and pedagogical, scientific staff of the University and persons studying at the University are determined in accordance with the regulations on professional (vocational), higher education, as well as specific conditions of study and service in the National Police of Ukraine.
V. UNIVERSITY MANAGEMENT, RIGHTS AND OBLIGATIONS OF THE HEAD OF THE UNIVERSITY AND OTHER BODIES
1. Direct management of the University activities is carried out by the Rector, who acts based on sole authority, is appointed and dismissed by the Minister of Internal Affairs of Ukraine.
The Rector of the University, within the limits of the powers granted to him/her:
-
manages the activities of the University, coordinates the work of the Vice-Rectors of the University, and organises the work on the effective management of the University;
-
issues administrative acts that are binding on all employees of the University's structural subdivisions;
-
represents the University in relations with public authorities, individuals and legal entities and acts without a power of attorney within the powers defined by the legislation of Ukraine and this Statute;
-
is responsible for the results of the University's activities to the MIA;
-
resolves issues of the University's activities, submits proposals to the organisational and staff structure (staff) and the staff list and budget of the University for approval to the MIA;
-
is the administrator of the property and funds of the University, within the budgetary allocations established in the estimates, concludes agreements, contracts;
-
appoints and dismisses vice-rectors of the University with the prior written consent of the MIA;
-
appoints, with the prior written consent of the Ministry of Internal Affairs, police officers who are seconded under Article 71 of the Law of Ukraine ‘On the National Police’ to the University and remain in the service of the police, heads of independent structural units in the areas of educational, scientific activities, personnel, financial and material support, as well as educational and research institutes (faculties), laboratories;
-
appoints and dismisses pedagogical, scientific and research and other employees of the University;
-
following the requirements of the Law of Ukraine ‘On the National Police’, assigns primary ranks of junior police officers and regular special ranks of junior and middle police officers up to and including lieutenant colonel of police to police officers in respect of whom he/she is a direct or immediate supervisor;
-
ensures occupational health and safety, fire safety, compliance with the law and internal labour regulations;
-
defines the scope of official duties of the University employees in their job descriptions (functional responsibilities);
-
heads the University Admissions Committee;
-
submits proposals for the distribution of University graduates who have studied or trained under the state order;
-
forms a contingent of persons studying at the University;
-
following the established procedure, expels, transfers and reinstates higher education students to study at the University;
-
ensures control over compliance with the legislation of Ukraine by employees and students of the University;
-
ensures the organisation and control over the implementation of educational programmes;
-
monitors compliance with organisational, staffing, financial and budgetary discipline by all units;
-
takes measures to ensure the secrecy regime, exercises constant control over the protection of state secrets, and the preservation of information with limited access at the University;
-
controls over the organisation of service and participation of the University staff in measures to ensure public safety and order;
-
is responsible for the condition and safety of firearms and ammunition;
-
applies incentives to employees (staff) and variable staff of the University, bringing them to disciplinary responsibility under the legislation of Ukraine;
-
controls the quality of work of pedagogical, scientific, research and teaching staff and other employees of the University;
-
together with the trade union organisations, submits for approval to the highest collegial body of public self-government of the University the internal regulations and the collective agreement and signs them after approval;
-
annually reports to the MIA and the general meeting (conference) of the University staff;
-
delegates, if necessary, some of his/her rights and duties to vice-rectors, heads of structural subdivisions of the University, except for the rights that cannot be delegated by the legislation of Ukraine;
-
take all measures provided for by the legislation of Ukraine to prevent, detect and combat corruption and related actions, to comply with anti-corruption legislation and to implement measures provided for by the anti-corruption programs of the Ministry of Internal Affairs and the University;
-
organises the implementation of measures for psychological support of the educational process of the University;
-
promotes and creates conditions for the activity of student (cadet) self-government bodies, scientific society of students (cadets, trainees), postgraduate students (adjuncts), doctoral students and young scientists, organisations of trade unions of the University employees, and public organisations operating at the University;
-
adheres to the principle of ensuring equal rights and opportunities for women and men in its activities within its competence;
-
ensures, within its competence, the implementation of regulations on observance of equal rights and opportunities for women and men, prevention and counteraction of gender discrimination and sexual harassment;
-
exercises other powers following the legislation of Ukraine and this Charter.
2. Vice-rectors of the University exercise their powers in accordance with job descriptions and functional responsibilities approved by the Rector of the University.
3. Participants of the educational process at the University are pedagogical, scientific, and pedagogical and scientific workers, students of professional (vocational), higher education and other persons who study or are involved in the educational process.
The rights and obligations of participants in the educational process are determined by the legislation of Ukraine and the contract (agreement) concluded between them and the University.
4. The collegial governing body of the University is the Academic Council of the University. The activity of the Academic Council is regulated by the legislation of Ukraine, this Statute and the Regulations on the Academic Council, which is approved by the order of the University.
The personal membership of the Academic Council is approved by the order of the University. The Academic Council consists of the following members by position: Rector, First Vice-Rector, Vice-Rectors, Heads of Educational and Research Institutes and Faculties, Academic secretary, director of the library, heads of self-government bodies and elected bodies of primary trade union organizations of the University employees, chief accountant, as well as elected officials representing scientific and pedagogical staff and appointed from among heads of departments, professors, doctors of philosophy (candidates of sciences), doctors of sciences, elected officials representing other employees of the University and working at it permanently, elected officials of postgraduate students, doctoral students, heads of elected bodies of primary trade union organizations of students and postgraduates, heads of student (cadet) self-government bodies of the University. At least 75 per cent of the total number of its members shall be scientific, research and teaching staff, and at least 10 per cent shall be elected representatives from among the persons studying at the University.
The Academic Council is headed by its chairman, who is elected in accordance with the legislation of Ukraine. The work of the Academic Council is organised by the Academic Secretary, who is appointed from among persons holding academic degrees and/or academic titles.
Academic Council:
-
determines the strategy and perspective directions of development of educational, scientific and innovative activities of the University;
-
develops and submits to the highest collegial body of public self-government a draft Statute of the University, as well as decisions on amendments and additions to it;
-
approves the financial plan and annual financial report of the University;
-
submits to the Rector of the University proposals for the direction of the amount of excess revenues from fees for services provided by the University following its main activities;
-
submits to the Rector of the University proposals for the effective management of property assigned to the University on the right of economic management;
-
determines the system and approves procedures for internal quality assurance of higher education;
-
decides on the placement of its revenues in the territorial bodies of the State Treasury Service of Ukraine or banking institutions;
-
makes decisions on the formation, reorganisation and liquidation of structural subdivisions upon the proposal of the Rector;
-
approves educational programs and curricula;
-
makes decisions on the organisation of the educational process, determines the terms of study at the relevant levels;
-
approves the sample and procedure for the processing of documents on higher education, including joint and double diplomas;
-
approves the main directions of research and innovation activities;
-
evaluates the scientific and pedagogical activities of structural subdivisions;
-
assigns the titles of professor, associate professor and senior researcher to scientists and submits relevant decisions for approval to the Certification Board of the Ministry of Education and Science of Ukraine;
-
makes final decisions on the recognition of foreign documents on higher education, academic degrees and academic titles when hiring pedagogical, scientific, research and teaching staff and other employees, as well as when enrolling applicants for study;
-
has the right to submit a motion to recall the Rector on the grounds provided for by the legislation of Ukraine and this Statute, which is considered by the general meeting (conference) of the University staff;
-
approves the symbols and attributes of the University;
-
considers other issues of the University's activities that do not contradict the legislation of Ukraine.
The Academic Council convenes at least once a month.
The agenda of the meeting of the Academic Council is formed by the Academic Secretary, taking into account the proposals of the educational and research institutes, faculties, as well as the proposals of the members of the Academic Council.
A meeting of the Academic Council is valid if at least two-thirds of its members are present.
The decision of the Academic Council is considered adopted if a majority of the members of the Academic Council who took part in the voting supported it.
Decisions of the Academic Council are put into effect by orders of the University.
Academic councils of structural subdivisions may be formed at the University, the powers and procedure for the formation of which are determined by the Academic Council. The Academic Council may delegate some of its powers to the academic councils of structural subdivisions.
5. The Supervisory Board of the University is established by the decision of the Ministry of Internal Affairs to supervise the management of the property of the University, in compliance with the purpose of its creation.
The Supervisory Board of the University exercises public control over its activities, as well as contributes to solving the perspective tasks of its development, attracting financial resources to ensure its activities and control over their use, establishing effective interaction of the higher education institution with state and local governments, the scientific community, socio-political organizations and business entities in the interests of increasing the competitiveness of the University, etc.
The Supervisory Board of the University has the right to submit to the highest collegial body of public self-government and/or the Ministry of Internal Affairs a motion to recall the Rector on the grounds provided for by the legislation of Ukraine and the Statute of the University.
The procedure for the formation of the Supervisory Board of the University, its term of office, competence and procedure of activity are determined by the Regulations on the Supervisory Board of the University, which is approved by the Academic Council of the University. Students and employees of the University cannot be members of the Supervisory Board of the University.
6. To solve current issues of the University's activities and to develop a strategy and directions for the implementation of educational and/or scientific activities under the legislation of Ukraine, other working and advisory bodies are formed, the provisions of which are approved by the decision of the Academic Council in accordance with the requirements of the legislation of Ukraine.
7. To increase the efficiency of management activities, preserve and enhance the best traditions, assist in improving the educational process and research work at the University in accordance with the legislation of Ukraine, the position of Advisor to the Rector may be introduced on a voluntary basis or at the expense of the University's own revenues.
Appointment and dismissal of the Advisor to the Rector of the University are carried out by the Rector of the University in agreement with the Academic Council of the University.
The powers of the Advisor to the Rector of the University are determined by the Regulations on the Advisor to the Rector of the University, approved by the Academic Council.
VII. PUBLIC SELF-GOVERNMENT BODIES
1. The supreme collegial body of public self-government of the University is the general meeting (conference) of the University staff, including elected representatives from among students (cadets) (hereinafter – the Conference).
The decision to convene the Conference shall be taken by the Academic Council of the University or the Rector in agreement with the trade union committee of the primary trade union organisation.
The Conference shall be deemed valid if it is attended by at least two-thirds of the elected delegates.
Decisions of the Conference are made by a simple majority of votes of the delegates present. The Conference shall be convened at least once a year.
Other issues of preparation and holding of the Conference of the labour collective shall be determined by the regulations approved by the Academic Council.
Delegates to the Conference from the structural subdivisions of the University are elected according to quotas established by the decision of the Academic Council or by order of the University. At least 75 per cent of the delegates (members) of the elected body shall be academic, research and teaching staff of the University who work at this institution permanently, and at least 15 per cent shall be elected representatives from among students (cadets) elected by students (cadets) by direct secret ballot.
The Conference:
-
approves the Statute of the University or amendments (additions) to it upon the proposal of the Academic Council;
-
hears the annual report of the Rector of the University and evaluates his/her activities;
-
elects a labour dispute commission following labour legislation;
-
considers, upon a reasonable proposal of the Supervisory or Academic Council of the University, the issue of early termination of the Rector's powers;
-
approves the internal regulations of the University and the collective agreement;
-
considers other issues concerning the University's activities.
2. A public self-government body of an educational and scientific institute (institute, faculty), which is a meeting (conference) of the staff, including elected representatives from among the persons studying at the University, may carry out its activities at the University.
The Academic Council of the University approves the Regulations on public self-government bodies of educational and scientific institutions (institute, faculty).
3. The University has bodies of cadet (student) self-government, the structure and system of which, as well as issues within their competence, are determined by the relevant regulations approved following the procedure provided for by the legislation of Ukraine.
Representative, executive and control and audit bodies of the cadet (student) self-government are elected for one year. Cadets (students) elected to the bodies of cadet (student) self-government may be removed from their positions by a general secret ballot. To initiate such a vote, signatures of at least 10 per cent of the cadets (students) of the University must be collected.
When a person's studies at the University are terminated, his/her participation in the cadet (student) self-government body is terminated in the manner prescribed by the provisions on cadet (student) self-government of the University.
Bodies of cadet (student) self-government:
-
participate in the management of the University following the procedure established by the legislation of Ukraine and this Statute;
-
participate in discussing and resolving issues of improving the educational process, research work, awarding scholarships, organising leisure, health improvement, welfare and nutrition;
-
participate in activities (processes) to ensure the quality of education;
-
participate in solving the issues of ensuring proper living conditions for cadets (students) in dormitories and catering;
-
protect the rights and interests of cadets (students) who receive education at the University;
-
delegate their representatives to working, advisory and consultative bodies;
-
adopt acts regulating their organisation and activities;
-
conduct organisational, educational, scientific, sports, recreational and other events;
-
dispose of funds and other property on the balance sheet and bank accounts of cadet (student) self-government bodies;
-
make proposals on the content of curricula and programmes;
-
submit proposals for the development of the material base of the University, including issues related to the life and recreation of cadets (students);
-
perform other functions stipulated by the legislation of Ukraine and regulations on the cadet (student) self-government of the University.
In their activities, the bodies of the cadet (student) self-government of the University are guided by the legislation of Ukraine, the Statute of the University and the regulations on cadet (student) self-government of the University.
4. The University has a scientific community of cadets (students), adjuncts (postgraduate students), doctoral students and young scientists. In its activities, the scientific community is guided by this Statute and the Regulations on the Scientific Community of the University, which are approved by the Academic Council of the University.
5. The University administration has no right to interfere with the activities of scientific communities of students (cadets, trainees), postgraduate students (associate students), doctoral students and young scientists, except when such activities contradict the legislation of Ukraine, the Statute or harm the interests of the University.
VІІ. PROPERTY AND FUNDS OF THE UNIVERSITY
1. The material and technical base of the University consists of land plots registered on the right of permanent use, buildings, structures, communications, equipment, vehicles, dormitories and other property assigned to the University on the right of economic management and accounted on the balance sheet of the University.
2. The University as a state-owned higher education institution to ensure the activities provided for by this Statute, is assigned property that cannot be pledged and is not subject to withdrawal or transfer of ownership to legal entities and individuals without the consent of the Ministry of Internal Affairs and the highest collegial self-government body, except in cases provided for by the legislation of Ukraine.
3. Control over the efficiency of use and preservation of the property assigned to the University shall be exercised by the Ministry of Internal Affairs.
4. The alienation of property belonging to fixed assets by the University shall be carried out exclusively on a competitive basis by the decision of the Ministry of Internal Affairs, following the procedure established by regulatory legal acts.
5. The University shall have the right to dispose of property belonging to fixed assets in any other way only within the powers and in the manner provided for by the Commercial Code of Ukraine and other laws of Ukraine.
6. Write-off of property from the balance sheet of the University shall be carried out following the requirements of the legislation of Ukraine.
7. The University shall use land and implement the rights of the owner of land plots, including the acquisition of relevant rights to land, by the Land Code of Ukraine.
8. The University shall be financed from the state budget on the terms of the state order for the payment of training services for specialists, research and scientific and pedagogical staff and from other sources not prohibited by law, in compliance with the principles of targeted and efficient use of funds, publicity and transparency in decision-making.
9. Funds received by the established procedure by the University as payment for the provision of services, performance of works, grants, gifts and charitable contributions, as well as funds from the sale of products or property and other activities by the established procedure shall be credited to accounts opened in the territorial body of the State Treasury Service of Ukraine and other bank accounts not prohibited by law.
10. The lease of state property assigned to the University shall be carried out without the right to buy it out under Ukraine's legislation, in agreement with the Ministry of Internal Affairs.
11. The funds from the general and special budgetary funds shall be allocated to the implementation of the statutory activities of the University following their designated purposes, for both current and capital expenditures, within the limits of the budgetary appropriations and financial estimates approved by the MIA.
12. The University's budget shall include expenditures related to the development of the material-technical and laboratory infrastructure, as well as the provision of licensed software products necessary for conducting educational and research activities.
13. The funds received by the University as payment for tuition, training, retraining, professional development, or for the provision of educational services may not be withdrawn to the revenue of the state or local budgets, except in cases stipulated by the legislation of Ukraine.
14. The procedure and conditions of remuneration shall be determined under applicable legislation. The conditions for awarding bonuses shall be established following the University’s approved regulations on incentive payments.
15. Following the procedure established by the legislation of Ukraine, the University shall have the right to:
-
establish a permanent (endowment) fund of the University and manage the revenues generated from its use under the terms and conditions governing the operation of such a fund, as well as to receive property, funds, and material assets as prescribed by law;
-
hold ownership rights to objects of intellectual property created at the expense of its funds or funds from the state or local budgets (except in cases specified by legislation);
-
create its own or, under contractual arrangements, utilise other material and technical infrastructure to conduct educational, scientific, innovative, or economic activities;
-
establish and develop, under the legislation of Ukraine, its infrastructure for social and domestic services, and a network of sports and recreational, health care, and cultural-artistic facilities;
-
exercise other rights as provided by the law.
VІII. PROCEDURE FOR REPORTING AND OVERSIGHT OF FINANCIAL AND ECONOMIC ACTIVITIES
1. The University independently maintains accounting records and prepares financial, budgetary, statistical, tax, and other types of reporting under the legislation of Ukraine, which it submits to the relevant state authorities in the prescribed manner.
2. The Rector of the University is responsible for the organization of accounting and for ensuring the recording of all financial and economic transactions in primary documents, as well as for the preservation of processed documents, registers, and reports for the period established by law.
The Rector of the University shall:
-
establish the necessary conditions for the proper maintenance of accounting records and ensure strict compliance by all departments and employees involved in accounting with the accountant's requirements regarding the procedure for processing and submitting primary documents for accounting;
-
ensure the timely and full payment of taxes, fees, and other mandatory contributions as stipulated by the legislation of Ukraine;
-
be responsible for the organisation and implementation of internal control under the budgetary legislation of Ukraine;
-
ensure the submission to the MIA of detailed calculations and substantiated funding requirements under the general and special funds for the maintenance of the University for the planned and the two subsequent budgetary periods;
-
ensure the targeted, rational, and efficient use of budgetary funds allocated for the maintenance of the University;
-
ensure the organisation and conduct of inventory procedures by creating the necessary conditions, as well as determining the objects, frequency, and terms of inventory following the procedure established by law.
3. The Chief Accountant of the University is appointed to and dismissed from the position by the Rector of the University with the approval of the structural unit of the MIA responsible for exercising the functions of the chief budget administrator in matters related to the organization of the budgetary process.
4. The Chief Accountant of the University shall:
-
ensure compliance with the established unified methodological principles of accounting, as well as the timely preparation and submission of financial, budgetary, statistical, tax, and other types of reporting;
-
organise control over the accurate reflection of all financial and economic operations in the accounting records;
-
participate in the preparation of documentation related to shortages and the reimbursement of losses caused by deficiencies, theft, or damage to assets;
-
ensure verification of the state of accounting in the University's separate structural units;
-
exercise ongoing control over compliance with accounting procedures and the preparation of financial, budgetary, statistical, tax, and other reports.
5. The audit of the University's financial and economic activities is conducted in accordance with the legislation of Ukraine.
ІX. WORKING AND ADVISORY BODIES
1. To address current operational matters of the University, working bodies are established, such as the Rectorate, the Admissions Committee, the Scientific and Methodological (Scientific Council, Methodological Council) Council, among others.
2. To develop strategies and directions for educational and/or scientific activities at the University, the Rector has the right to establish, voluntarily, advisory (consultative) bodies (Employers’ Council, Investors’ Council, Business Council, Student Council, Scientific Council, and others).
3. The regulations on the working and advisory bodies shall be approved by the Academic Council of the University under this Charter.
X. INTERNATIONAL COOPERATION
1. The University has the right to engage in international cooperation, enter into cooperation agreements, and establish direct connections with higher education institutions in foreign countries, international organisations, foundations, and other entities, under the legislation of Ukraine and the procedures established by the MIA.
2. Main Areas of International Cooperation of the University:
-
participation in bilateral and multilateral intergovernmental and inter-university exchange programs for higher education students, as well as for teaching, scientific-pedagogical, and research staff;
-
conducting joint scientific research;
-
organising international conferences, symposia, congresses, and other events;
-
participation in international educational and scientific programs;
-
joint editorial and publishing activities;
-
providing services related to higher and postgraduate education to foreign citizens in Ukraine;
-
creating joint educational and scientific programs with foreign higher education institutions, scientific organisations, and other entities;
-
sending pedagogical, scientific-pedagogical, and research staff abroad for teaching, scientific-pedagogical, and research work under international agreements of Ukraine and contracts with foreign higher education institutions and partners;
-
involving foreign pedagogical, scientific-pedagogical, and research staff in teaching, scientific-pedagogical, and research work at the university;
-
sending university students to study at foreign educational institutions;
-
promoting academic mobility for scientific, scientific-pedagogical, and pedagogical staff as well as students;
-
participation in the work of international organisations;
-
other directions and forms of cooperation.
3. The University's foreign economic activity is carried out under the legislation of Ukraine.
XІ. THE PROCEDURE FOR AMENDING AND SUPPLEMENTING THE UNIVERSITY STATUTE
1. Proposals for amendments and additions to the Statute of the University may be submitted by the Ministry of Internal Affairs, the Rector of the University, the Supervisory Board of the University, the Academic Council of the University, or the Conference.
2. A decision to make amendments, additions, and approve a new version of the Statute is made by the Conference through an open vote, with a simple majority of the delegates present.
3. Amendments and additions to the Statute of the University are approved in the prescribed manner by an order of the MIA.
4. Amendments and additions to the Statute of the University enter into force on the day of their state registration.
XІІ. PROCEDURE FOR THE REORGANISATION AND LIQUIDATION OF THE UNIVERSITY
1. The termination of the University’s activities as a legal entity is carried out under the legislation of Ukraine through liquidation or reorganisation (merger, affiliation, division, transformation).
2. The implementation of the decision to terminate the University’s activities is carried out by a liquidation commission established by the MIA.
3. From the moment the liquidation commission is appointed, it assumes the authority to manage the University. The liquidation commission prepares the liquidation (distribution) balance or transfer act of the University and submits it to MIA in the prescribed manner.
4. The release of employees during the liquidation (reorganisation) of the University is carried out in compliance with labour legislation.
5. In case of the termination of the University’s activities, its assets are transferred to another non-profit organisation that falls under the jurisdiction of MIA and is designated in the prescribed manner.
